Marketplace Terms
Version v1 · Last updated: July 2026 — draft pending legal review
1. You buy from third-party sellers
Products on the marketplace are sold by independent third-party sellers — the seller of record shown on each product page — not by Thumper. Thumper operates the marketplace and collects your payment as each seller's limited payment-collection agent: your payment to Thumper fully discharges your payment obligation to the seller, even if the seller never receives funds from us.
2. The two balances
Your account can hold two separate balances that never mix. Cloud/GPU Credits pay for compute only — they are closed-loop, non-transferable, non-cashable, and can never buy marketplace products. Your Marketplace Balance is funded only by card top-ups (1 credit = $1, no bonuses), spends only on marketplace purchases, cannot be sent to other users, and cannot be cashed out. Refunds return to your Marketplace Balance by default. Value is held and moved by our payment processor (Stripe) and its banking partners — Thumper never takes custody of your funds.
3. Prices, tax, and receipts
Prices are shown in credits (1 credit = $1 USD). Applicable sales tax is calculated at checkout and shown in your total before you confirm — tax is collected and remitted by Thumper as marketplace facilitator. Every purchase produces an itemized receipt showing the seller of record and the descriptor that appears on your card statement.
4. What a purchase grants
A purchase grants a personal, non-transferable license (an entitlement) to download and use the product under its stated license terms — it is not ownership of the underlying work, and passthrough license obligations (e.g. attribution) shown on the product page bind you. Entitlements are revoked on refund, chargeback, or a platform integrity/moderation removal. Files already on your device stay on your device — revocation stops future downloads and support.
5. Chargebacks — talk to us first
Our refund policy is faster than a card dispute. Filing a chargeback on a marketplace top-up freezes both balances and suspends purchasing while it is investigated (fraud protection). Contact support before disputing a charge.
6. Non-expiry and closure
Purchased balance does not expire (CARD Act). On account erasure, remaining balance handling follows the refund policy and applicable unclaimed-property law. See also the Refund Policy and Prohibited Content Policy.
